OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO US FOR ACCESSING OR USING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.

The Indemnified Parties reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Citizens 4 Homes.

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
  • Dispute Resolution: Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the federal or state courts located in San Diego County, California. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
  • Class Action Waiver: YOU AGREE TO BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Miscellaneous
